1 Acceptance of Terms & Age Eligibility
These Terms of Use (“Agreement”) constitute a legally binding agreement between you (“User”, “Subscriber”, or “Patient”) and FES HealthTech (“Company”, “we”, or “us”) governing your access to and use of the Murshid Companion mobile application (“the App”).
🔞 Age of Majority & Strict Prohibition of Direct Minor Use:
You must be at least 18 years of age (or the legal age of majority in your jurisdiction) and possess full legal capacity to use the App. Direct use, account creation, or independent operation of the App by children or minors under 18 is strictly prohibited, whether with or without parental awareness. If a pediatric dependent is following a clinical nutritional plan, the account must be created, held, and operated exclusively by their adult parent or legal guardian on the child's behalf.
By creating an account, linking with a clinic, or accessing your diet plan, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use and our companion Privacy Policy. If you do not agree, discontinue use of the App immediately.
2 Crucial Medical & Emergency Disclaimer
🚨 NO EMERGENCY OR ACUTE DIAGNOSTIC CARE:
MURSHID COMPANION IS NOT AN EMERGENCY DISPATCH OR TRIAGE SERVICE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, SUDDEN SHORTNESS OF BREATH, CHEST PAIN, ANAPHYLAXIS, HYPOGLYCEMIC CRISIS, OR ANY ACUTE SYMPTOM, CALL YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY (e.g., 997, 911, or 112) OR VISIT THE NEAREST HOSPITAL EMERGENCY ROOM.
Educational & Adherence Companion Only:
- The App acts as an administrative and technological communication conduit between you and your healthcare professional.
- FES HealthTech is a digital health technology company, not a healthcare provider, clinic, or medical practice. The App itself does not practice medicine, diagnose diseases, prescribe pharmaceuticals, or modify clinical treatment plans.
- Always consult your licensed physician or treating healthcare provider before initiating any new diet, caloric deficit, intense physical workout, or nutritional supplement program.
3 Clinic Relationship, Plan Authorship & Clinical Records
All dietary guidelines, meal assignments, caloric requirements, exercise schedules, supplement dosages, and appointment determinations presented inside the App are authored, calibrated, and managed solely by your independent licensed clinical dietitian or healthcare clinic.
FES HealthTech exercises zero clinical oversight and possesses zero editorial control over the dietary advice dispensed by your treating specialist. Any clinical questions, adverse food reactions, or required modifications must be addressed directly to your treating provider.
Furthermore, official medical and clinical records created by your healthcare specialist remain under the independent custody and governance of the treating clinic. Any requests to review, update, or modify your formal clinical files must be directed to your specialist or clinic administration directly.
4 User Responsibilities & Biometrics Accuracy
To ensure safe and effective clinical oversight by your specialist, you agree to:
- Provide accurate, truthful, and up-to-date biometrics, body weight measurements, physiological statuses (such as pregnancy, lactation, or medical conditions), and allergy disclosures.
- Never withhold relevant medical history or pre-existing conditions from your treating healthcare team.
- Maintain the confidentiality and physical security of your smartphone, tablet, and account credentials.
5 End-to-End Encryption & Cryptographic Key Custody
Because Murshid Companion utilizes hardware-backed, client-side encryption (Curve25519 & AES-256-GCM), you maintain primary custody of your encryption keys.
Backup Obligation: If you lose, reset, or change your device without an active encrypted Google Drive backup, your past encrypted telemetry and local records cannot be reconstructed by FES HealthTech support personnel, as our servers never hold your private decryption keys.
6 Permitted & Prohibited Conduct
You agree to use the App solely for your personal, non-commercial health management. You shall not:
- Decompile, reverse engineer, disassemble, or extract source code from the App.
- Interfere with, bypass, or probe any security mechanisms, cryptographic protocols, or server rate-limits.
- Impersonate another patient or link with an unauthorized clinic without their clinical consent.
- Use the App to distribute malicious code, bots, or automated scrapers.
7 Intellectual Property
The Murshid Companion software, interface design, graphic assets, animations, icons, trademarks, and algorithms are the exclusive intellectual property of FES HealthTech and are protected by applicable copyright, trademark, and patent laws. You receive a limited, revocable, non-exclusive, non-transferable license to use the App for personal health tracking.
8 Disclaimers & Limitation of Liability
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR UNINTERRUPTED ACCESSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL FES HEALTHTECH, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR ANY HEALTH COMPLICATIONS, DIETARY MISADVENTURES, OR INJURIES ARISING FROM YOUR ADHERENCE OR NON-ADHERENCE TO ADVICE PRESCRIBED BY YOUR CLINIC.
9 Governing Law & Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts of the Kingdom of Saudi Arabia.
