1 Acceptance and Agreement
By using the Murshid app ("App"), you fully agree to these terms and conditions issued by FES HealthTech ("Company"). If you do not agree to any of these terms, please stop using the app immediately.
To use the app, you must be:
- At least 18 years of age
- A qualified dietitian or health professional
- Using the app for legitimate professional purposes
2 Account and Registration Data
Your Murshid account is personal and non-transferable to any other party. You are solely responsible for:
- The confidentiality of your login credentials and not sharing them with anyone else
- All activities that occur under your account, whether authorized by you or not
- Notifying us immediately of any suspected unauthorized access via email: legal@feshealthtech.com
- The accuracy and correctness of the data you enter upon registration
FES HealthTech does not store or have access to your actual passwords. We utilize secure, industry-standard third-party authentication services (such as Google and Apple Sign-In) which securely retrieve your email, display name, and profile picture URL to build your secure credential profile. We are committed to applying the highest security standards to protect your account profile and data in accordance with our Privacy Policy. We do not utilize your profile picture or display name for clinical or marketing purposes, keeping them strictly within the authentication layer.
3 License of Use
FES HealthTech grants you a limited, non-exclusive, non-transferable license to use the Murshid app for personal professional purposes only. This license is conditional upon your full compliance with these terms.
The following activities are explicitly prohibited:
- Reselling, licensing, or redistributing the app to third parties in any form
- Modifying, hacking, decrypting, or reverse-engineering any part of the app
- Creating derivative or branched apps from the app or any of its components
- Using the app for collective commercial purposes without a special enterprise agreement signed with FES HealthTech
- Attempting to access restricted areas of servers or databases
- Removing or altering any intellectual property notices contained within the app
Internet Connectivity & Offline Grace Period
To ensure maximum security, verify the integrity of your subscription status, and safeguard your data by synchronizing it with our secure cloud servers, the Murshid App requires an active internet connection periodically.
- Offline Mode Privilege: We understand the dynamic nature of clinical environments. Therefore, you are granted a "Grace Period" allowing you to use the core features of the App completely offline for up to 45 consecutive days.
- Mandatory Synchronization (Security Lock): If the App remains disconnected from the internet for a continuous period exceeding 45 days, the user interface will be temporarily locked. This is a mandatory security measure to prevent unauthorized access, ensure data integrity, and validate subscription entitlements.
- Restoration of Service: The lock is temporary and strictly protective. Full access will be instantly restored without data loss the moment a secure internet connection is re-established and the App completes its synchronization protocol.
4 Dual Wallet System
The app operates on a dual wallet system consisting of two types of points, each with different usage rules and conditions:
🔵 Blue Points
- Completely free and earned by watching ads and daily in-app rewards
- Designated for local operations only, such as adding patients, performing metabolic calculations, and exporting PDF reports
- Non-transferable to other accounts or refundable for cash in any form
- May automatically expire 90 days after discontinued use
- Are equivalent in value to local operation units and are not a currency with monetary value
🟡 Gold Points
- Designated for smart data extraction (OCR) operations and cloud services requiring external cloud resources.
- Can be acquired through a subscription plan (PRO), purchased as direct one-time packages via app stores, or earned through promotional rewards and referrals.
- Subscription Quota Points: Users subscribed to the "Murshid Pro" plan receive a monthly quota of 500 Gold Points. These points are valid only during the active subscription billing cycle. They do not accumulate or roll over to the next month; any unused subscription points are automatically reset and replaced with the new cycle's quota of 500 points.
- Expiration & Cancellation: If the subscription expires, is canceled, or fails to renew, any remaining Gold Points granted under the subscription quota will be immediately revoked and forfeited.
- Permanent Points: Points earned through promotional actions, direct one-time package purchases, or ads remain permanent and valid for one full year from the acquisition date, and are not affected or revoked by subscription cancellation.
- Consumed after successful execution of an operation and are non-refundable after consumption under any circumstances.
- Managed in the cloud via Firebase to ensure integrity, prevent manipulation, and ensure cross-device synchronization.
- Are not legal tender or financial instruments and cannot be converted into cash.
5 Acceptable and Unacceptable Use
✅ Acceptable Use
- Managing real patients with sincere professional intent according to the ethical standards of the profession
- Using smart extraction tools (OCR) and local calculation engines to facilitate the professional dietitian's work
- Exporting customized reports as PDF files to share with patients within a legitimate, consent-based professional relationship
- Backing up clinic data for the purpose of maintaining patient records
- Customizing app settings and visual identity to match the clinic's workflow
- Using the Patient Follow-up Web Form feature to collect clinical data securely from patients, subject to acquiring necessary clinical and legal consents
🚫 Prohibited Use
- Attempting to hack or manipulate the points system, databases, or servers in any way
- Using the app for unprofessional purposes, fraudulent commercial gain, or misleading patients
- Sharing patient data with unauthorized parties in violation of data privacy laws
- Creating fake accounts or entering fake patient data to manipulate points
- Using automation tools (bots) or scripts to consume points, scrape data, or artificially view ads
- Attempting to bypass the ad system or access Pro features without proper payment
- Manipulating, altering, or spoofing the device's date and time settings (Time Manipulation) to bypass the offline grace period, evade subscription renewals, or deceive the App's security verification systems
- Uploading harmful content, viruses, or malware via app features
- Attempting to intercept, manipulate, or bypass the end-to-end encryption of the patient web form, or using modified versions of the form page to collect unencrypted patient data
Violating any of these clauses may prompt the actions mentioned in Section 9 of these terms.
6 Clinical and Accounting Disclaimer
The Murshid app, with all its local calculation engines (e.g., macro calculators, food-drug interaction engine, and pediatric Z-Score growth engine) and smart extraction tools (OCR), is considered an auxiliary technical and administrative toolkit for qualified professionals. It is not a substitute for the clinical and professional judgment of the dietitian.
You explicitly acknowledge and agree to the following as a fundamental condition of using the app:
- All nutritional, clinical, and financial decisions are your exclusive responsibility as a licensed professional and do not fall upon FES HealthTech
- The results of the calculation engines and OCR tools do not constitute a medical diagnosis, a prescription, or an automated clinical consultation
- The app is not certified or licensed as a medical device (Software as a Medical Device - SaMD) by any international or local health regulatory authority
- FES HealthTech is not responsible for any health, legal, or tax damage resulting from reliance on the calculations or OCR extraction without independent review by the dietitian
- The dietitian must always verify the inputs and outputs of the calculators and the customized report with the patient before officially approving it
- Generating electronic invoices and receipts (including ZATCA invoices and VAT) is done locally with the dietitian's inputs, and the company bears no accounting or tax liability before official authorities
- The use of the app is not permitted for non-health or non-nutritional professionals who are unqualified to make professional decisions
Patient Web Form Feature, Decryption, & Data Control
- Role of the Dietitian as Data Controller: Under global data protection laws (e.g. GDPR, CCPA, Saudi PDPL), you (the registered dietitian) are the sole "Data Controller" of the patient records. FES HealthTech has zero access to decryption keys or the patient's health data. You are entirely responsible for the secure handling, local decryption, storage, and retention of patient-submitted files.
- Verification of Imported Data: The dietitian must independently inspect and verify the accuracy of all data imported from the patient web form (including biometrics like height and weight, medical history, allergies, and lab results) before officially saving it to the patient profile. FES HealthTech bears no clinical liability for any diagnostic or therapeutic decisions made based on erroneous patient-entered inputs.
- Third-Party Communication Channels: Sharing of the encrypted
.mrshedfile occurs manually via third-party services (such as WhatsApp or email). FES HealthTech is not responsible for the security, availability, or potential data exposure during transmission through these third-party platforms. - Consent of Minors: You represent and warrant that you will obtain all necessary parental or guardian consents prior to sending the E2EE follow-up form link to any patient under the legal age of majority in your jurisdiction.
- Secure API Proxy & Cryptographic Integrity: The App routes Cloud OCR image processing via FES HealthTech's secure Firebase Cloud Functions. You agree not to intercept, bypass, or manipulate the traffic routing to our Cloud Functions, nor attempt to access or hijack secret API tokens used to authenticate calls to third-party services (such as Google Gemini AI).
7 Intellectual Property and Data Scraping Ban
All elements of the app are protected under international intellectual property and commercial laws. The rights are distributed as follows:

Regarding user content: your patients' data and their local records remain solely your property. FES HealthTech claims no ownership rights over them. Furthermore, it is explicitly prohibited for any user or third party to scrape food data (Data Scraping) or reverse engineer the app, under penalty of international judicial liability.
8 Third-Party Services
The app relies on trusted third-party services to provide its core functionalities. Below is a list of these services and their purposes:
- Firebase (Google): Authentication, gold points management, and subscription state
- Google Gemini AI (OCR API): Real-time image processing to extract lab tests and medication texts
- Google AdMob: Advertising network to generate free blue points
- Google Drive API: Optional backup of encrypted clinic data
- Google Play / Apple App Store: Processing payments and subscriptions
FES HealthTech is not responsible for any interruption, change in terms, or permanent cessation of these services. The continued availability of certain app features is conditional upon the availability of these services.
Routine Maintenance and Service Availability
FES HealthTech reserves the right to temporarily suspend cloud features for routine maintenance and security updates. We are committed to making our best effort to minimize downtime, and planned maintenance periods do not constitute a breach of service nor warrant any financial compensation.
Mandatory App Updates
FES HealthTech reserves the right to enforce mandatory app updates (Forced Updates) to ensure the accuracy of clinical calculations, enhance security, and maintain server compatibility. The use of deprecated versions that may contain security vulnerabilities or computational flaws is strictly prohibited. The Company bears no responsibility for any damage resulting from attempting to bypass update requirements or using unsupported versions.
9 Account Suspension and Termination
FES HealthTech has the right to suspend or terminate your account immediately or following a review in the following cases:
- Violation of any clauses in these terms, especially those relating to prohibited use and the ban on scraping
- Documented suspicion of fraudulent activity or manipulation of the points or ad systems
- Failure to pay due subscriptions after the specified grace period has elapsed
- Receiving credible complaints from patients regarding the misuse of their data
- A request from official legal or regulatory authorities to suspend the account
Upon account termination:
- The license granted to you is immediately revoked, and you are no longer authorized to use the app
- The cloud gold points associated with your account are deleted, and you have no right to claim a refund
- Patient data saved locally on your device remains intact and is unaffected by the account termination
- You may export your data prior to the final confirmation of termination during the grace period
10 Limitations of Liability and Warranties
The app is provided "AS IS" and "AS AVAILABLE" without any express or implied warranties, including warranties of fitness for a particular purpose, non-infringement, or continuity.
Maximum Liability:
The maximum liability of FES HealthTech towards you in any dispute is equal to the amounts you paid for the app during the twelve months preceding the dispute, and it cannot exceed this limit under any circumstances.
The Company is Not Liable For:
- Indirect, incidental, or consequential damages, regardless of their cause
- Loss of profits or revenues resulting from app downtime
- Loss of data resulting from user negligence, failure to retain device keys, or lack of backups
- Loss of patient data or clinical records generated and stored exclusively on your local device during prolonged "Offline Mode" usage, should the device be lost, damaged, stolen, or the App uninstalled before a successful cloud synchronization is executed
- Damages resulting from the interruption of third-party services mentioned in Section 8
- Erroneous clinical or accounting decisions made by the user based on calculations or OCR readings without independent review
- Any unauthorized access, loss, interception, or exposure of patient data during manual transmission of encrypted files from the patient's browser to your device via third-party communication channels (e.g., WhatsApp, Email).
Force Majeure
FES HealthTech is not responsible for any delay or failure to perform its obligations caused by exceptional circumstances beyond reasonable control, including: general outages of global cloud server infrastructure, international cable network failures, natural disasters, emergency sovereign or governmental decisions, and outages of global store services.
Some jurisdictions do not allow the exclusion or limitation of liability for incidental damages, so some of these limitations may not apply to your specific legal situation.
11 General Provisions and International Jurisdiction
Applicable Law and Dispute Resolution
These terms and agreement are governed by international commercial regulations and laws, and the laws applicable in the official headquarters of FES HealthTech. Both parties agree to first seek to resolve any dispute or disagreement through an amicable settlement and direct negotiations within 30 days from the date of written notice. In the event an amicable settlement is not reached, the dispute shall be referred to commercial arbitration or the competent courts in the country of the company's headquarters.
Modification of Terms
FES HealthTech reserves the right to modify these terms at any time with a prior notice of no less than 30 days via email or a prominent notice within the app. Your continued use of the app after the modifications take effect constitutes your implicit acceptance of them.
Official Notices
All official notices of a legal nature will be sent to the email address associated with your account. You may contact the company at: legal@feshealthtech.com. Notices are deemed received within 48 hours of being sent.
Severability and Survival
If a competent judicial authority rules that any provision of these terms is unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect. The failure of any party to exercise their stated rights does not constitute a waiver thereof.
